Those risks include — without limitation — muscle, tendon, ligament, and bone injury; cardiac events; syncope and loss of consciousness; hypoglycaemia; hypotension; electrolyte disturbance; dehydration; heat illness; cold injury; overtraining syndrome; hormonal disruption; nutrient deficiency; eating-disorder relapse; psychological distress; and, in rare cases, death.

By reading, downloading, or applying any part of any Fittssy publication or any feature inside the Fittssy app you acknowledge, accept, and assume those risks fully and voluntarily. You agree that any action you take based on anything Fittssy publishes is taken entirely at your own risk, on your own initiative, and under your own responsibility. You agree that the existence of a Fittssy publication, purchase, or account does not create a professional, fiduciary, medical, or coaching relationship between you and Fittssy, between you and any author, or between you and any person associated with Fittssy.

Nothing Fittssy publishes is a promise, guarantee, warranty, or representation of any specific outcome — physical, athletic, cognitive, aesthetic, metabolic, psychological, emotional, financial, or otherwise. References are provided inside each publication so you can — and should — check the primary sources yourself. No claim in any Fittssy publication has been reviewed, endorsed, or certified by any regulatory body, academic institution, professional association, or medical review board.

Any mention of third-party devices (wearables, heart-rate monitors, continuous glucose monitors, recovery tools, supplements, apps, services, or brands) inside any Fittssy publication or the Fittssy app is for reference only and is not an endorsement. Fittssy does not receive payment for any reference made unless explicitly and visibly disclosed. You are responsible for evaluating any third-party product or service before use, for following its manufacturer's instructions, and for complying with its own terms.

To the maximum extent permitted by applicable law, Fittssy™, Fittssy, its officers, directors, employees, contractors, authors, contributors, reviewers, affiliates, licensors, and assigns (collectively, the ‘Fittssy Parties’) shall not be liable to you or to any third party for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including, without limitation, damages for bodily injury, death, illness, pain, emotional distress, lost wages, lost opportunity, lost data, loss of privacy, or any other loss — arising out of or in any way connected with your access to, reading of, reliance on, or application of any Fittssy publication, the Fittssy app, or any AI-generated output inside the Fittssy app, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not any Fittssy Party has been advised of the possibility of such damages.

Where applicable law does not permit the exclusion of certain warranties or the limitation of certain damages, the Fittssy Parties’ aggregate liability to you for any claim arising from or related to any Fittssy publication or any free feature of the Fittssy app is limited to the amount you actually paid for that specific publication or that specific feature, or ten pounds sterling (£10), whichever is less. Aggregate liability for paid subscriptions and LEGEND purchases is governed by the Terms of Service.

By using any Fittssy publication or any feature of the Fittssy app you waive, release, and forever discharge the Fittssy Parties from any and all claims, demands, actions, causes of action, liabilities, damages, costs, and expenses (including legal fees) — known or unknown, present or future — that you or your successors may have against any Fittssy Party arising from your use of, reliance on, or reference to any Fittssy publication or feature.

You agree to indemnify and hold the Fittssy Parties harmless from any claim brought by a third party arising from your misuse, republication, redistribution, or misapplication of any Fittssy publication.

Fittssy publications are intended for readers aged 18 or over. If you are under 18, do not apply any protocol in any Fittssy publication without the direct supervision of a parent, legal guardian, and a qualified clinician who has personally evaluated your health. Use of the Fittssy app itself requires a minimum age of 16 as stated in the Terms of Service; any paid digital product purchase requires a minimum age of 18.

This disclaimer and any dispute arising from or related to it or to any Fittssy publication are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales shall have exclusive jurisdiction. If you are a consumer resident in the European Union, you retain any mandatory consumer-protection rights under the laws of your country of residence.

If any provision of this disclaimer is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

By purchasing, downloading, reading, or applying any Fittssy publication, or by using the Fittssy app, you confirm that you have read, understood, and accepted this disclaimer in full, that you have agreed to the Fittssy Terms of Service and Privacy Policy, and that you accept full and sole responsibility for any decision you make on the basis of anything Fittssy publishes.
